Use of Force - Moment of Threat vs. Totality of the Circumstances

The United States Supreme Court has examined whether the Fifth Circuit erred in applying the “moment of threat” doctrine in analyzing the reasonableness of an officer’s use of force. The doctrine limits consideration to the officer’s perspective at the precise moment of the threat, excluding prior actions. This presentation will update the current analysis standards for the use of force.  This will include the Court's examination of the totality of the circumstances standards versus whether pre-threat circumstances should be considered. How will this ruling address concerns about officer training and real-world implications? Attendees will be updated on the current trends related to updates by the Supreme Court. Attendees will be provided an evaluation of the Pre-threat indicators and Officer Jeopardy standards. Attendees will learn about the Totality of the Circumstances analysis for the Supreme Court.
